I own a rental property in the small town of Kulpmont, PA . l was informed a few months ago by the town that an ordinance was passed that would effect any landowner that rents one or more units in the town. So I went to the Kulpmont website and downloaded the ordinance. I am not sure if most of the landowners there read them, but I did. And I was disgusted to say the least. This is the way it reads.
I must obtain a rental permit, that will remain in the rental unit, and must be shown to any Kulpmont employee that ask to see it. And inspections on rentals can also be done! I must furnish them with my tenants last copy of their occupational tax. I must show them proof that my taxes are paid, along with proof of paid sewer bill. And I have to show them proof of insurance for a certain amount. It also states that I am responsible for my tenants actions.
And if the police or code officer are called to a residence 3 times in 12 months that they have a right to evict my tenants. And it states that this miscontuct clause does not mean a criminal offense. If a tenant is evicted for this misconduct clause, that they will not be able to enter into another rental or lease agreement within the borough for 12 months! It also states that if a landlord lives more than 30 miles away from the property that they must have an agent. There is also a registration fee that they will decide the amounts.
In the letter they wrote me it was 100.00 per landlord.and let me be clear here. If I own 50 units its 100.00 and if you own 1 you pay 100.00. I am wondering what council member that voted this in has rental units there or has a friend that has many units that they couldn't even make the fee look fair.
Now I am almost sure that these laws or ordinances are unconstitutional and illegal. I wrote to the Mayor and council member about this ordinance and expressed my distaste! I will not subject my tenants to having a permit in their home. So any Kulpmont employee there can knock on the door and ask to see their papers and do an inspection! And they do have police as employees!
I will not pay someone or give someone the authority to speak for me, or make decisions for me about my property or anything else in my life for that matter! I will not prove to them my bills are paid. Or that I have insurance for a certain amount, even though I have more than what is in there ordinance. And I will not pay a fee that is that unfair, and I am not getting a service for my fee!
I got a ticket in the mail from the code officer for not registering my rental property..even though they know that I own it and who my tenants are. I let them know who my tenants are so they would know not to give me a ticket if they don't cut the lawn or do snow removal. That is in their lease, if they don't do it give them the ticket. When I got the ticket I noticed that he had the address wrong! Wrong street! Well I sent him a picture of a hundred dollar bill!
Now I got a ticket from the magistrates office for failure to pay citation 1137 the one with the wrong address on it, failure to pay fee, failure to get an agent, and faliure to give information. As it stands right now it is just landlords and not homeowners that live at their residence.
But the people of America better wake up! It will be you next! But not if I can help it! I will go to jail before I will bow down to a government agency that thinks they they have a right to this kind of thing! I will not let my rights and liberty be taken from me without a fight! And if the rest of America does not wake up, you will all wake up one day to total government control over our lives! If anyone has any suggestions on how to fight this please contact...
