Laws that assist effective health care

Principles for this goal

Create a nation wide medical/health care environment where:

...Government does not give privilege to or place restrictions on any type of medical/health care method.

...Government assistance is provided to those unable to pay for expensive, catastrophic medical/health treatments.

...Insure a broad range of competitive medical/health insurance options.

...Individual choices for medical/health treatment are many.

Remove any type of government enforced restrictions on any type of medical/health treatment educational facilities/methods.

Suits at law against claimed medical/health maltreatment are not allowed.

Each state shall have a board to adjudicate and pay claims for damages resulting from medical/health maltreatment. The board may authorize state prosecution against individuals responsible for a medical/health paid claim.

The FDA will lose its authority to approve or disapprove medical drugs. It will gain the responsibilities to collect, examine and publicize complaints against medical drugs and health supplements. It will also gain the responsibility to sample health supplements and drugs for meeting label statements for fraud where sampling is random and repeated over time.

Private organizations may assign approval or disapproval ratings for any type of medical/health treatment method or treatment educational facilities.

State medical licensing and insurance laws must be uniformly changed.

A license should only announce the education and grades received. The State should provide an easy to read license for posting in treatment offices that demonstrate to a customer that the state has validated the truth of the education and grades claims.

Board certification should be demanded for certain specialties such as surgeon.

Laws against practicing general medicine must be eliminated. However law against practicing a specialty without board certification must be enforced and punished strongly.

Let the customer choose without government control, but with government assistance and protection as above.

Allow competition for health insurance without restrictions.

Many will choose to only buy insurance for expensive, catastrophic illness treatment.

For those below the poverty level of income have the Federal Government pay for expensive illness types of insurance on a monthly basis.

The Federal Government pays 50% of the insurance fee for those below two times the poverty level.

It is the responsibility of the insurance company for validation of income level and application for government payment.

Prosecution of course for insurance companies engaging in fraud.
