Our Constitution is being taxed despite sworn oaths

With their fake anger on display 328 representatives turned their backs on their oath of office while insuring everyone understands clearly our Constitution means nothing to them. “These people are getting away with murder,” said House Ways and Means Committee Chairman Charles Rangel of New York. “They’re getting paid for the destruction they’ve caused to our communities.”

These 328 are getting paid for the destruction they're causing to our Constitution yet where is their special tax or willingness to return their pay? H.R. 1586 is blatantly unconstitutional yet why should that be any concern to these reactionary congress critters?

The voices of reason turn to Article 1, Section 9 of the Constitution which reads, "No Bill of Attainder or ex post facto Law shall be passed." Opponents of the legislation say it violates this section due to the idea a Bill of Attainder is against a specific group while those favoring it are confident it would not hold in a court of law since the bill extended the 90% tax to more than just AIG. A fine hair to split since it is still a small group impacted. However, the other part of the Constitutional statement discusses ex post facto or after the fact laws.

"An ex post facto law is a law passed after the occurrence of an event or action which retrospectively changes the legal consequences of the event or action," according to Lectric Law Library. The event has occurred, bonuses have been paid, thanks to the Dodd Amendment to the TARP legislation (yes, the one he said first he didn't and then...whoops, he did agree to but only 'cause our big, mean Treasury Department made him).

Now, in knee jerk fashion as a diversionary tactic due to angry constituents, we have legislation being proposed to counter the poor law quickly passed without in-depth thought. In other words, these representatives made a major mistake and are more than willing to make another one without any concern for the burden being placed on our Constitution. Most are confident it would make it through the Supreme Court which should not surprise anyone since the courts have not provided Congress with an unconstitutional ruling since FDR's staking scheme skewed their judgment in 1937.

Each of the 328 representatives, however, took an oath to defend the Constitution against enemies foreign and domestic. In defending something we do not kind of defend it or get as close to not defending it as possible in hopes no one will challenge what we are doing. We defend it with honor, integrity, and loyalty no matter the consequences. In this case 93 voted against this threat to our Constitution even though there are just as many upset constituents in their districts as the others. It does not matter, right is right when it comes to the laws these legislatures make.

Given the nature of what these elected representatives are attempting to do think about the future possibility if they get away with it. The next group they turn specific tax laws against may be one YOU are a part of. This is how our Constitutional liberties are eroded. Poorly thought out, quickly assembled, emotionally charged legislation that later grows into laws that bind us down in ways our founders could never imagine.

What can you do? First, see if your representative voted for or against this disastrous bill. Second, contact them with either condemnation if they voted for it or appreciation if they stood in defense of their oath. Third, contact your Senators and let them know you expect them to defend our Constitution when they vote next week on similar legislation. Finally, stop the assaults on our liberty, stop voting to send these types of representatives back every year. We now have 328 who do not either understand or care about their oath so start finding a replacement for them today!

I would tell you what I think of these Jackbooted Government Terrorists in OUR Congress, but there may be women and children reading. I'll just say that I have lost complete confidence in OUR Government and about 328 of them should be impeached for knowingly violating OUR Constitution which they have sworn to uphold. This isn't about AIG, this is about Freedom which is slowly being stolen from us and our children.

“They’re getting paid for the destruction they’ve caused to our communities.”

Of course, congress intends to protect their monopoly on that!
