Leading by example the people of New Hampshire have boldly put the federal government on notice with HCR 6 - A Resolution affirming States' rights based on Jeffersonian principles.  Currently in committee, introduced for all to hear.

Can you imagine any state in today's economic turmoil putting the federal government on notice? Well, that is exactly what New Hampshire has done and all other states should follow their example. With their House Concurrent Resolution they've spelled out exactly what violations will no longer be tolerated. More over the resolution doesn't stop at a mere legislative warning but carries it to the executive and judicial realms as well. Listen to the language from the resolution; hear it echo in your mind.

"That any Act by the Congress of the United States, Executive Order of the President of the United States of America or Judicial Order by the Judicatories of the United States of America which assumes a power not delegated to the government of United States of America by the Constitution for the United States of America and which serves to diminish the liberty of the any of the several States or their citizens shall constitute a nullification of the Constitution for the United States of America by the government of the United States of America."

Following this is a listing of actions which would cause the nullification. A caveat to the list is that it is not all limiting yet only an example of abuses which the federal government must no longer undertake. Clearly stating the consequences HRC 6 continues, "That should any such act of Congress become law or Executive Order or Judicial Order be put into force, all powers previously delegated to the United States of America by the Constitution for the United States shall revert to the several States individually."

Anyone believing they are alone should realize there are many patriots striving for the restoration of our foundational principles. Here is a legislature willing to lead by way of active legislative resolution consideration. Reading through the entire resolution anyone will be bolstered with pride who stands against the tyrannical course our immerging socialist democracy is currently on. As we see this level of resistance we can take heart in knowing our time of restoration is coming.  If/when this is passed there should be bells ringing across the land.

Gary Alder states in his About' section of his educational website (The American Constitutional Paradigm), "While we hope that this website will be of service in building honorable representatives such as Davy Crockett in Not Yours to Give,* we are more interested in creating the Horatio Bunces that will hold their representatives accountable to theConstitution." Gary reminds us of the importance of being one of those voices of accountability. What we are witnessing in New Hampshire is an entire state legislative body embracing the spirit of Horatio Bunce.

Does your state have the integrity and intestinal fortitude to follow suit? I'm not sure mine does but we must at least make each of the other 49 states aware of this example and ask the question. If they do not then elections may take on a whole new meaning as we strive to continue our search for honorable representatives who embrace the core principles that gave birth to our wonderful country. Thank you New Hampshire, I for one salutes your stance for liberty and freedom!

In 1799 Thomas Jefferson laid out New Hampshire's right for this resolution when he said;

"RESOLVED: That the principle and construction contended for by sundry of the state legislatures, that the general government is the exclusive judge of the extent of the powers delegated to it, stop nothing short of despotism; since the discretion of those who administer the government, and not the constitution, would be the measure of their powers: That the several states who formed that instrument, being sovereign and independent, have the unquestionable right to judge of its infraction; and that a nullification, by those sovereignties, of all unauthorized acts done under colour of that instrument, is the rightful remedy."

It appears that this resolution has only been introduced in the legislature and not yet passed. Is that correct?

Yes, it is in committee.  Due out of committee on 3-19 with the next hearing slated for 2-5.

The main challenge was simply letting people know about it, I believe.  The word is getting out and many in New Hampshire will rally to insure their representatives support this legislation.  I believe the exposure has moved it from possible to actually have a fair chance.  We'll all have to keep an eye on it.

New Hampshire has tended to be a libertarian-type state. If they pass this, it will be a great victory for federalism, at least ideologically. However, they must also restore their historic state militias in order to be able to actually back up these claims against the feds if things get ugly (Dr. Edwin Vieira has written much on the militia issue). I suggest that anyone who supports this measure contact every one of their own state's legislators and start getting things like "America: Freedom to Fascism" (available on Google video) and Judge Andrew Napolitano's book "Constitutional Chaos" into their hands ASAP; caution: these resources contain some offensive content.

LOL Steve.  We may be packing it up with you.  There's an article published last night on WA and I submitted one this morning (thanks Nick) outlining all 4 states; AZ, WA, NH, and OK (2008).  In this mornings article all are linked as well as links to great reading on the Constitution, etc.  I hope you check it out and socially bookmark it.
 Being in UT I'm not sure if there's a rep that will introduce this type of legislation but I'm going to ask.  You might as well ask TN.  If enough states join the sovereignty party the mass media will be hard pressed not to report it.  This should be big news!  Thank goodness for Walt and Nolan Chart as well as the Internet.  We'll be discussing it for sure on this Sunday's show, "The Government We Deserve"

I live in OK now, I have not heard anything about the Rez that they have submitted. Do you have any information about this? I served in the military for 6 years and am an Iraq Veteran. I have been out for 2 years and the more I research and learn about the government it scares me. What can people do and what rights can we use before the government starts attcking us and imprisoning us for standing up to them? I am just a concerned American that wants to make a differnce for my children and the people of the USA. Thank you for what you are doing.

I was at the public hearing on HCR6 yesterday - packed room, overflowed into hallway.  Positive, positive response to it from the committee, and all attendees to the public hearing.  There's footage of it online - google Free State Project and New Hampshire Liberty Alliance for forums/footage and also consider signing up for the Free State Project (I'd get to this state as quickly as possible, were I not here already - moved here last year in March, thank gosh.)  There's a chance, because of the strong show of support, including from other Reps, that this will be approved - many other states are doing this as well, but New Hampshire has a very organized and active native/new population regarding state rights/state constitution - this is the place to be right now.  If any state has great odds of getting a resolution of this type passed, it's New Hampshire.  Good luck to us all - and thank you to Nolan Chart for letting the Liberty community know about this.

Sadly, I doubt it will pass.  Maine, Vermont and New Hampshire have been invaded by thousands of Liberal-Socialists from New York City and the Boston area over the past ten years.  All three states used to be very independent, but the liberals from NY and Mass have deliberately invaded in order to ensure that the rural Libertarian-Conservative rural culture of Northern New England is destroyed. 

Taxes in Northern New England are almost as bad as here in NY and Mass, "environmentalists" are restricting farmers and hunters, they are now restricting the traditional school choice "tutitioning" laws and taking away the rights of parents to raise their children how they see fit.  It royally sucks. 

Never trust a rich city-slicker who buys a "country house" - within a few years all their friends will move in and demand the "best" most expensive schools and social services that the rural folks have lived without since this country was settled by their ancestors.  They will campaign for teachers' unions to gain more influence and destroy private industry, thereby forcing all the locals to rely on government jobs in healthcare and education (all unionized) and then the poor rural folks in the middle of "nowhere" will be convinced that these elite city-slickers have their best interests at heart when they campaign for excessive welfare benefits.

That's the story of Northern New England (the welfare problem is mostly in Maine).  All three states were solidly Republican 20 years ago, and now they are all controlled by Dems (same in NY); VT even has a self-professed Socialist as a senator (Bernie Sanders).  Just go up there and ask any native Vermonter over the age of 35 whose family has lived there for generations and if you mention "Democrat" they will scathingly look at you at state "We are all Republicans here."  (That seriously happened to my mom).  The problem is that their kids have been brainwashed by the Liberals from NY and Mass (ObamaBOTS).

My brother lives in Vermont.  There are essentially 2 Vermonts - real Vermonters and transplants.  Real Vermonters work on the ski slopes and dairy farms; transplants open up glitzy shops that sell high-priced cheese to ski bunnies from NY and Boston. The transplants simultaneously restrict farmers from digging ponds on their own property (apparently man-made waterholes destroy the environment; this is a lie - up until 10 years ago all environmental agencies encouraged ponds because they actually help protect water sources and wildlife).  The elite transplants just want to make sure that they are the only people allowed access to a water view.  These elite Liberals hawk artisanal cheese and then turn around, buy up all the farmland and turn it into luxury condominium developments.  People from NY and Mass move in and demand state-of-the-art schools and hospitals and services, so taxes go up.  Apparently condos don't harm the environment, but ponds, loggers and hunters do.  And then, of course, the liberal city-slickers cannot bare the site of a natural meadow of wildflowers, so they plant fields of sod, and grass must be mowed, so they truck in tons of illegals from NY and Mass to cut the grass and clean their condos, then when they get sick they go to the emergency room and the hospitals lose money and taxes go up yet again.

Over the past ten years in Vermont school taxes have doubled along with the number of teachers; ironically, over that same amount of time the number of students has steadily fallen.  Why?  Because the Teachers Union has been supported by the unions in NY and Mass and now has more power than all the residents in Vermont put together.

Oh yeah, don't underestimate the fact that the Massachussetts Liberals will send in all their lawyers to stop this bill dead in its tracks.  Remember, Mitt Romney's buddies from Mass blanketed the caucuses in Maine and illegally influenced the votes - right in front of the poll watchers.  Mitt Romney is nothing but a Liberal in RINO garb.  The whole gay marriage Constitutional amendment crap is all his fault - he listened to some freak activist judge in Texas and legalized gay marriage in Mass and now everyone thinks that the government has the "right" to define marriage.  Marriage isn't a right at all and the government is not in the business of "defining" anything; leave that to Webster and Oxford.
