WASHINGTON, DC, DECEMBER 8 - All eyes from the Democratic National Party, and many others from around the nation focused for a moment on the Supreme Court, which has just decided that they would not hear the lawsuit Donofrio vs. Wells, which alleges Obama is not constitutionally eligible to be president per the Washington Post. A request had been made to postpone the Electoral College vote set for December 15 so that the case could have been heard.
[12/09/08 RETRACTION: Previously, this article claimed that attorney Leo Donofrio of New Jersey would appear at the WTP press conference as per their WTP website and letter below. Mr. Donofrio replied writing, "Please correct your story. I am Leo Donofrio and I have nothing to do with the National Press Club event tomorrow. Nobody will represent my case there, and I am not involved with the others who have brought suits." It appears his name was used by the WTP without his permission. His website is here, although I profess I cannot check it from where I live in China due to firewall issues. My humblest apologies to Mr. Donofrio and all. ]
A group known as the We The People Foundation held a separate press conference this afternoon, and may have had another two attorneys present (Attorneys Philip Berg (PA) and Orly Taitz (CA)) to issue statements summarizing their arguments and path forward. There are at least 10 other lawsuits in various stages filed in other states. WTP issued their statement today, outlining their next steps. (Photo link)
WTP paid for a scathing full-page open letter ad that ran in Obama's hometown newspaper, the Chicago Tribune, on two days last week. WTP has sent five (5) public open letters in November to President-elect Obama requesting he immediately release his birth certificate for examination by a team of forensic experts. At the top of the WTP website is a great shot contrasting his "birth certificate" with his "birth certification."
The Washington Times published an article December 5 titled "An Imposter in the White House?", complete with a shifty-looking picture of Obama.
No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.
I enjoyed reading WTP's letter (sorry, cackling in glee is in truth more apt), and have made the point in this column previously that if Obama does not address this, he will consistently be labeled an usurper for his entire reign, a la Bush-Gore 2000, only much worse since he is clearly at fault. Here it is in full:
Representing thousands of responsible American citizens who have also taken an oath to defend the Constitution of the United States of America, I am duty bound to call on you to remedy an apparent violation of the Constitution.
Compelling evidence supports the claim that you are barred from holding the Office of President by the "natural born citizen" clause of the U.S. Constitution. For instance:
You have posted on the Internet an unsigned, forged and thoroughly discredited, computer-generated birth form created in 2007, a form that lacks vital information found on any original, hand signed Certificate of Live Birth, such as hospital address, signature of attending physician and age of mother.
Hawaii Dept of Health will not confirm your assertion that you were born in Hawaii.
Legal affidavits state you were born in Kenya.
Your grandmother is recorded on tape saying she attended your birth in Kenya.
U.S. Law in effect in 1961 denied U.S. citizenship to any child born in Kenya if the father was Kenyan and the mother was not yet 19 years of age.
In 1965, your mother legally relinquished whatever Kenyan or U.S. citizenship she and you had by marrying an Indonesian and becoming a naturalized Indonesian citizen.
You have repeatedly refused to provide evidence of your eligibility when challenged to do so in a number of recent lawsuits. Incredibly, the judge in Hawaii actually said it would be an invasion of your privacy for him to order access to your original birth certificate in order to prove your eligibility to hold the Office of President.
Before you can legitimately exercise any of the powers of the President you must meet all the criteria for eligibility established by the Constitution. You are under a moral, legal, and fiduciary duty to proffer such evidence. Should you assume the office as anyone but a bona fide natural born citizen of the United States who has not relinquished that citizenship, you would be inviting a national crisis that would undermine the domestic peace and stability of the Nation. For example:
You would always be viewed by many Americans as a poseur - a usurper.
As a usurper, you would be unable to take the required "Oath or Affirmation" on January 20 without committing the crime of perjury or false swearing, for being ineligible you cannot faithfully execute the Office of the President of the United States.
You would be entitled to no allegiance, obedience or support from the People.
The Armed Forces would be under no legal obligation to remain obedient to you.
No civilian in the Executive Branch would be required to obey any of your proclamations, Executive Orders or directives, as such orders would be legally void.
Your appointments of Judges to the Supreme Court would be void.
Congress would not be able to pass any needed legislation because it would not be able to acquire the signature of a bona fide President.
Congress would be unable to remove you, a usurper, from the Office of the President on Impeachment, inviting certain political chaos including a potential for armed conflicts within the General Government or among the States and the People to effect the removal of such a usurper.
In consideration of the escalating constitutional crisis brought on by the total lack of evidence needed to conclusively establish your eligibility, I am compelled to serve you with this First Amendment Petition for a Redress of this violation of the Constitution.
With all due respect, I ask that you immediately direct the appropriate Hawaiian officials to allow access to the vault copy of your birth certificate by our forensic scientists on Friday, Saturday and Sunday, December 5, 6 and 7, 2008.
In addition, I ask that you deliver the following documentary evidence to the National Press Club in Washington DC by 10 am on December 8, 2008, marked for my attention:
A certified copy of your original, signed "vault" birth certificate.
Certified copies of your reissued and sealed birth certificates in the names Barack Hussein Obama, Barry Soetoro, Barry Obama, Barack Dunham and Barry Dunham.
A certified copy of your Certification of Citizenship.
A certified copy of your Oath of Allegiance taken upon age of maturity.
Certified copies of your admission forms for Occidental College,
Columbia University and Harvard Law School.
Certified copies of any legal documents changing your name.
Each member of the Electoral College, who is committed to casting a vote on December 15, 2008, has a constitutional duty to make certain you are a natural-born citizen. As of today, there is no evidence in the public record (nor have you provided any) that defeats the claim that you are barred by law from assuming the Office of President because you fail the Constitution's eligibility requirements.
All state Electors are now on Notice that unless you provide documentary evidence before December 15, that conclusively establishes your eligibility, they cannot cast a vote for you without committing treason to the Constitution.

FreeRepublic.com has call-in numbers for all of Hawaii's hospitals, and claims to have called each one and been told by each that Obama was not born there, nor did his mother ever visit. Now, I am certainly not a "right-winger," and Philip Berg, the attorney that started this whole circus, is a politically-active Democrat (until he started this lawsuit, that is!). I would still raise these questions even if it was an individual I liked, but geez, tonight I may have to laugh myself to sleep.
Back to my bold title, which I thought about in September but did not wish to publish since it seemed so far-fetched at the time. If Obama is ruled constitutionally ineligible, it does seems likely Joey Biden will be selected by the Electoral College. Perhaps Obama would be eligible to be his VP. This would be an utter irony since Joey was destroyed early in the Democratic primaries by the lawyers three - Obama, Clinton, and Edwards.
In conclusion, Obama certainly appears as if he is hiding the truth from us; he is on trial for no crime, but to prove his qualification to be President, which is the responsibility of each individual aspiring to this office. His lack of cooperation proves this man will treat the Constitution with the same disrespect as Bush. When Obama opens his mouth to start stating the oath without proving he is eligible, he will be a fraud for the rest of his life in my eyes, edging out George W. Bush for the new all-time record.

A)Hawaiian law, at the time of Obama's birth, allowed for FOREIGN born baby's to be registered in Hawaii via a 'Certificate of Live Birth':

B) The Hawaiian govt' officials NEVER stated that Obama was born in Hawaii. They only stated that they have seen his birth certificate on file. But a B.C. from where?? (see #1 above).
On October 31, 2008, Dr Chiyome Fukino, Department of Health:
"Therefore, I as Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, have personally seen and verified that the Hawai‘i State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures."

For the Hawaiian 'Policies and Procedures' she refereed to…see item #1 above which, again, affords foreign born babies to obtain a Hawaiian COLB.
Legally, the Hawaiian Governor & the Dpt of Health official merely stated fact based on their own laws. One can obviously see that a Kenyan B.C. from 1961 would be legal and valid per Hawaiian law. This would also allow Obama to obtain a U.S. Passport.
In other words, all of the people born in Korea, Kenya, Mongolia, Australia (etc) and who also have Hawaiian birth certificates also have REAL birth certificates.

Obviously, what the Obama camp has released looks nothing like those two Hawaiian COLB's from that time. Where's his?
D) If it's proven Obama was indeed foreign born (Kenya), He would NOT have received U.S. citizenship based, only, on his mother's citizenship status. Per U.S. law at the time of his birth (December 24, 1952 to November 13, 1986).
"If only one parent was a U.S. citizen at the time of your birth, that parent must have resided in the United States for at least ten years, at least five of which had to be after the age of 16."

Obama's mother didn't give birth to him at 21 (16 + 5). Therefore, Obama could not obtain U.S. citizenship based only by virtue his mother's citizenship.
E) And then there is the dual citizenship issue (which could make the above totally irrelevant). Factcheck themselves state that Obama was indeed a British subject and did in fact hold dual citizenship AT Birth.

So even IF he was indeed born in Hawaii (would be easy for him to prove but hasn't so far), Obama could therefore not be a Natural Born citizen because Natural Born citizens can not hold dual citizenship at birth. It has to do with the potential for divided loyalties and the very reason the
writers of the Constitution themselves allowed for their exception (grandfathered in) because all of them were British Subjects at birth.
He might be a "Naturalized" Citizen, but there is nothing (to date) in the public sector to suggest he is a 'Natural Born" Citizen, the Constitution clearly requires for one to become POTUS.
F) Without question, the Secretary of State of New Jersey (& possibly other SoS's) did NOT do their job in making sure the presidential candidates (including Obama) were qualified and eligible to be on their states' ballot. [This is, in part, the subject of Leo Donofrio's lawsuit.]

How would the SoS from NJ explain that Roger Calero was on their ballet as a candidate?
Socialist Workers Party candidate Roger Calero isn't even a U.S. citizen (Naturalized OR Natural Born), yet appeared on NJ’s presidential ballot.
Calero was also allowed on the state ballot in: Delaware, Minnesota, New York and Vermont.

Was Barack Obama born in Hawaii? Was Hawaii part of the United States at the time of his birth? If the answer to both questions is, "Yes," then he IS a natural born United States citizen, as defined by the 14th Amendment of the Constitution itself. I tend to agree with you since the Indonesian thing is a weaker claim, but my stance is that a court should decide. You are right this likely will not end well, but who is to blame? Who decided to keep their birth certificate (not "certification of live birth" they are different) from the American people?
My opinion is Obama should be blamed, and to a lesser extent also his supporters who should have demanded, in his and their best interests, he produce his fides to the satisfaction of all! Instead, his supporters were basically blinded by the light of His presence. Not a good thing.

FAX TODAY to person in charge in Hawaii (of birth certificates, or to the Governor) INSISTING that IAW section XYZ of Hawaii constitution/law, that a "certified copy of OB's ORIGINAL vault copy of OB's birth certificate" be sent to the designated JUDGE; and (2) send the same via OVER NIGHT MAIL with letter which can be legally proven by Hawaii authorities, hospital records, and submitted into court.
3. Print it every day or two. Then if a satisfactory response is NOT given, then have various JUDGES in USA sue Governor of Hawaii.
I agree that the constitution must be obeyed. If he is not a natural born citizen he cannot be president. However as a matter of the effect on US political decisions it probably won't make much difference. If Obama is disqualified it will probably make Biden the president and that ain't no improvement! It might even result in Hillary being VP. Arghhh!!!

I don't understand the controversy. If he was born on American soil, which Hawaii is, then regardless of his parent's nationality he is a natural born citizen. End of argument.

I think this is where most reasonable people start scratching their heads and wondering what you're smoking, Jake.
If you're a "Champion of the Constitution", it presumably follows that you have actually read the constitution and are aware of its contents. In the presence of the Senate and the House of Reprsentatives, the President of the Senate will count the votes of the College of the Electors and declare a President and Vice President of the United States. The elected President and Vice President will be inaugurated. That is what the Twelfth Amendment says.about electing a President. The Twentieth Amendment says that the term of the new President and Vice President will begin at noon on January 20th.

Sorry for the cackling, its hard for me to believe that the Constitution is being treated with ANY type of respect. I had been aware of this issue since March, but withheld from writing about it until the Conventions ended with candidate selections in September. My other articles on this subject have a more, dare I say, professional tone. (Also I didnt believe so many people would be reading it, nearly 4000 hits in less than 24 hrs is a lot for little old me.)

Now, as a citizen, when you apply to get your passport, you have to submit your original birth certificate to the government. They get to examine it.
[For that matter, I remember when I signed up for Little League as a kid, my parents had to show my birth certificate to the township board to verify my birthday!!]
Now the Constitution is a queer document for some. You see, it was written by the representatives of We the People to bind and constrain the government, not to bind and constrain the People.
So if someone is going to be President, what is wrong with a citizen like myself has the sheer tenacity to insist that Barack Obama show his birth certificate to prove his age and to prove he is "Natural Born"? Past presidents have not had this issue since its been pretty clearcut.
McCain had this issue and was taken to court. What did he do? He slammed his birth certificate on the counter and the judge ruled him eligible.
Obama was taken to court earlier too. What did he do? Refused to show it, and the judge issued a lengthy 34-page rebuttal of garbage that did not address the points the attorney made at all, and dismissed the case saying the attorney as a citizen had no standing to file suit
At this point, I will only be satisfied with Obama having a court rule in his favor that he is eligible.

Jake maybe you missed it this morning but the US Supreme court ruled it would not I repeat would not hear the case brought against President Elect Obama. Your argument has been false since the beginning and the US Supreme court also concures that it has more important issues to hear rather than conspiracy theory individuals like yourself and Mr Berg. The upcoming lawsuits will meet similar fate as well. Drop this madness of trying to overturn the will of the people with your uninformed interpretation of the US Constitution. And to answer your question, he doesn't have to show you anything no more than you have to show your birth certificate to me. Those that needed to see it have seen it and verified it valid and real. By showing you all that would happen is that you would claim it is not authentic. The Hawaii governor also a Republican and many others with much more credibility than you and others like you with similar thoughts and intentions have all concluded the validity of all requested certificates.

While I hear and understand your points, I am afraid the Constitution is not a conspiracy. You wrote "Those that needed to see it have seen it and verified it valid and real". OK, then. Who has seen it and publicly verified it by notary and the press? You call ME a conspiracy theorist? What's the big secret? He was born with only 8 toes?
If I was Senator Obama, I would be rubbing my birth certificate in anyone's face.
Remember my T-Ball analogy. As a six-year-old I had to show it to verify my age and get assigned to a team. Same thing when you get your Dept of Homeland Stupidity passport. If I run for President, what's the big deal?
This fraud is a lying criminal traitor guilty of treason twice under the Logan Act. He is not a natural born citizen- even if he were born in Hawaii, he lost citizenship upon adoption by Lolo Soetoro and acceptance of Indonesian Citizenship---as dual citizenship with US was not allowed- a fact proven by his travel to Pakistan in 1981, which was illegal to enter for US citizens. By setting foot in Pakistan, he disavowed his US citizenship or allegiance to the US, and used another citizenship to enter. The man is up to his unusually large ears in Chicago corruption and kickbacks, and has installed half of the Chicago Combine as his appointees. There has never been a greater fraud perpetrated on the US citizens than the lying criminal traitor illegally using the name Barack Obama. He holds the greatest office of this great land under an illegal name without US citizenship. UNBELIEVABLE. This man is not my president and it's an insult of unimaginable proportions to see him installed as President.
