OUR CIVIL LIBERTIES ARE IN PERIL

By Al Gutierrez

Lately, we have been either reading or listening to the news media about the portions of the Patriot Act that have been accused of violating the rights and liberties of Americans. These violations are having roving wiretaps, not having warrants to look into what individuals have been reading in libraries, etc.

Let us not forget of course the most recent development that came through the news media about the National Security Agency listening to telephone conversations of Americans calling overseas or from calls to the US from specific areas of the world. .

Libertarians believe in the Constitution as being the supreme law of the land and that such a document has to be interpreted in an originalist fashion meaning to look at the constitution as to what the Founding Fathers had intended. Libertarians further believe that government's power is to be limited by the Constitution.

Libertarians believe, based on the aforementioned, the federal government has apparently not complied with the constitution in particular with the right to privacy of its citizens as contained in the fourth amendment. The fourth amendment states "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."??

Libertarians further believe that we, the people of the United States, have the right to do that which we desire so long as those actions do not infringe on the rights of others. Libertarians believe in the principle of non-aggression.? If someone tries to commit an act of aggression, then we have the right to self-defense.

Libertarians believe that what the Federal Government is doing with the Patriot Act, as well as those actions of the NSA, represent an infringement of our Constitutional rights by BIG GOVERNMENT.? They believe that Government is trying to expand its power over we the people.

Ben Franklin, one of our Founding fathers stated the following: "They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety."

Libertarians do believe in the security of this country in that in the event of foreign or domestic aggression one of the limited roles that government has is to defend its citizens against aggression.

At this time, the President has the power to declare marshall law and thus suspend what we little have left in civil liberties.?The president clearly has not lived up to the oath he took to protect the constitution. This administration has apparently made  the effort to ignore what the Founding Fathers had established, .making the constitution meaningless except for an ocassional soundbyte.

Libertarians do believe in the security of this country in that in the event of foreign or domestic aggression one of the limited roles that government has is to defend its citizens against said aggression.

The Federal government has even usurped the rights of the states which goes against the tenth ammendment to the United States constitution as further evidence of our constitutional rights gradually being eliminated.

Another example of this is the elimination of Habeas Corpus.

The Libertarians believe that a necessity does exist to have measures in place to protect the citizenry. However Libertarians object to those portions of the Patriot Act and monitoring of phone calls where warrants are not obtained and signed by a judge upon demonstrating probable cause.

It is time America to wake up to this reality before it is too late
