Until quite recently, Senators Obama and McCain both had civil suits brought against them alleging they were constitutionally ineligible to serve as President. McCain chose to cooperate with the courts, produced his documents, and was ruled constitutionally eligible. However, the question for Obama is still open. He has not produced documentation in a court of law proving that he is eligible. This is also a helpful though biased blog page on the topic from an anti-Obama law student, you can see from the links on the right of the webpage he is following along closely.
On page 36 in this court ruling, Obama’s case was "dismissed for lack of subject matter jurisdiction" by U.S. District Judge R. Barclay Surrick on October 24. Converted into layman’s terms, the judge ruled that the plaintiff, Philip Berg (a constitutional Democrat), had no right to bring a lawsuit against Mr. Obama. This is the equivalent of telling all citizens in the United States that they have no right to challenge constitutional wrongs in the US District Court.
Berg will not be denied. He already planned for the eventuality long before the trial and will appeal to the Third Circuit Court of Appeals first, and if failing, to the United States Supreme Court.
On the Michael Savage Show on October 23, Berg stated that he has in his possession a verified translation and recording of Obama’s Kenyan grandmother, who is still alive, stating she was present at little Barack’s birth in Kenya.
It is undisputed that Obama’s father was a Kenyan national, and it is undisputed that if Obama was actually born in Kenya he is not eligible to be POTUS. Obama maintains he was born in Hawaii. Berg also states that even if Obama was born in Hawaii, he has in his possession school records that Obama was registered as a schoolchild with Indonesian citizenship in Jakarta, Indonesia, during the 1960s after his American mother’s second marriage. If this allegation is true, a court would need to decide on Obama’s eligibility to be President or even a Senator.
The Associated Press with its often negligent style of journalism titled its short seven-sentence blip of an article "Judge tosses lawsuit challenging Obama citizenship" on October 25. However, in their last sentence they did state the truth. "Surrick ruled that Berg lacked standing to bring the case, saying any harm from an allegedly ineligible candidate was "too vague and its effects too attenuated to confer standing on any and all voters.""
Although his motion to dismiss was perfectly legal, one now has to wonder. What does the man termed "the Messiah" or "The One" have to hide? For someone who supports physical searches performed on your person in public places on the strange supposition that everyone could be a terrorist, should We the People not have the right to search his person if he wants to take our highest office?
A lifetime liberal Democrat, Berg has said, "I am doing this for the Constitution."
Well, so am I.

PS I am biased, but I would say the same about anyone who refuses to prove he is constitutionally eligible. For being a constitutional law professor, Obama seems determined to follow it his way - the Socialist way. Here is a 2001 radio recording of how Obama will redistribute the riches of the wealth to the poor, to each according to his/her needs.
PPS Remember the POTUS is not selected on November 4th. Congress will not count the votes of the Electoral College until January 6, 2009. "No Constitutional provision or Federal law requires electors to vote in accordance with the popular vote in their States."

You'll just run down any old path someone tells you about, won't you, if it gives you a chance to jump on some anti-establishment bandwagon.
Don't you think the McCain people would have been all over this if it were true? Don't you think the Obama people would have had 15 papers out to disprove it if it were anything they were worried about? Or the NEWS MEDIA? At least the TABLOIDS? Oh yeah ~ I forgot ~ they're ALL in a BIG CONSPIRACY to tell lies and keep the truth that YOU believe under cover. Ha! Ha! Thank goodness, at least SOME people look into these things.
I've heard all these reports, and been to the websites MYSELF. They're just publicity seekers, hoping to get some payments from somewhere ~ anywhere! Money, money, money.
And, it seems to sucker you in EVERY TIME!

You bring up a very good question with why McCain doesn't attack. You would figure, even if the allegations are completely false, that he would do so anyways or at least distance it a little bit aways from his campaign.
Try to change the fact that there is a lawsuit. Just try. That's really the news, and it's not very well covered. You would think with an election in a week it would be. Again even if its completely false, this is the same media that started Anna Nicole Smith, OJ, Michael Jackson-type circus events and they do not want to start another one?

When there were allegations of voter fraud in FL and OH last election, the media was all over it. When there is a lawsuit filed in federal court against a candidate on the grounds of Presidential eilgibility the media does nothing. I don't understand.
I can't comprehend why McCain or the media has not gone after this lawsuit yet they go after Joe the Plumber (who was a fake).
Mr. Berg's allegations may very well be false and he is probably pissed because his candidate Hilary Clinton is not in the ballot. We don't know.
Joe the Plumber was a fake and the media was all over him.
The voter fraud or voter intimidation allegations last elections may have been fake and the media was all over it.
Mr. Berg's allegations may or may not be fake. Yet the media is silenced either way.
I don't belive in conspiracy theories they are usually fake too. But I don't understand why this is not even mentioned in the Big Media either. The media should either question Obama as a fake or Mr. Berg as a fake. Either way it still should be reported.
Whether the lawsuit has ground or not. it was filed and dismissed. That was a fact and it should have been reported.

So why hasn't Berg produced the recording? Why isn't FOX News all over this? Let's hear the damn recording, and have it verfied by a third party (Berg saying it's verified isn't good denough. Can't believe much of what this 9/11-Truther says) and get on with our lives.

For those who want PROOF:
Since when has ANYONE in the US had to prove their INNOCENCE? This flock of nay-nay birds is hovering around Obama like he's a wounded animal. He's FAR from anything close to that.
Consider these points:
1) Barack Obama has been scrutinized by magazines, newspapers, radio and tv commentators, other candidates, his opposition, political blogs, and the news media for more than 21 months. Books have been written both about him and by him, innumerable articles and feature stories have covered every aspect of his life – and his family – so that he has been thoroughly analyzed, discussed, and investigated.
2) Barack Obama has been in 29 national debates, televised and broadcast by very capable questioners, he toured all 50 states and several special provinces as he went through 53 primary elections so that his views on every issue that someone wanted to question him about were analyzed, discussed, and evaluated.
3) Barack Obama has put forth very detailed, comprehensive, specific programs on 26 different subjects from energy to poverty to the (so-called) war in Iraq. He discusses each program in detail, and spells out how it will be funded on his website.
4) Barack Obama has attracted and recruited very highly-respected and capable people to assist him in running for office and to serve in his administration when he is elected. These are people with a great depth of understanding and expertise about every subject that he will face as President, both men and women.
5) Barack Obama has energized new and traditional voters to contribute more money to his campaign than any politician in history, which indicates their support, confidence, and desire to have him serve as our chief executive.
6) Barack Obama has met with foreign leaders, military leaders, business professionals, and Congressional leaders about our country’s most troubling problems. He has discussed these issues with them, and offered his opinions as to how to improve them.
7) Barack Obama, as a member of the US Senate, has had to review spending priorities, budget allocations, and government policies for every kind of national issue from healthcare to bank reform to the (so-called) war in Iraq.
And, perhaps even more important than these other items,
8) Barack Obama has NOT voted or supported the moronic positions of the rabid Republican right regarding such issues as abortion, gay rights, stem cell research, original intent of Supreme Court justices, and the (so-called) war in Iraq.
I know that these points won't make ONE BIT OF DIFFERENCE to a white slave owner like you who wants to whip away on this black man who is better EDUCATED, better SPOKEN, better INFORMED, better off FINANCIALLY, and better SUPPORTED by other people than YOU will EVER BE.
Why don't you face up to facts? He's got a LOT of experience, he's been through a LOT of scrutiny, and he has a LOT of answers. You just choose to ignore the obvious.

I agree with you absolutely that Berg needs to produce all of his evidence. But browse the link to the 36-page court dismissal and note what I said - Obama has refused to provide documentation, and the court dismissed saying Berg has no right to file the lawsuit because he has no potential of being harmed.
Therefore the court is not even pondering the evidence. Therefore I almost dont mind if Berg waits until he has his day in court. I am sure that if he fails to reach or is dismisssed by the supreme court, he will release everything he has. There is of course the possibility that Berg is wrong - I've looked at his background in the Democratic Party and I find it hard to believe that HE is a fraud, but its certainly possible that his evidence is fraudulent.
It is not fair to either say Obama is not eligible or Berg is wrong without giving them their day in court.
It would also be interesting if ANY of the many presidential candidates, esp the ones who have a mathematical chance like Barr, Nader, Baldwin and McKinney took up the suit after 11/4, since they would surely have a claim that they were "wronged"
I think you realize that Berg will be ostracized and blackballed by the Dems for the rest of his life for doing this.
I 100% agree with your sentiments to just get this all done and over with. Mr. Obama could have done that by producing his documentation. Instead, he took the perfectly legal but (I claim) morally questionable way out.
Remember, this election is not the court's. In a way, it's not even ours. This vote goes to the Electoral College, and I believe they are also constitutionally bound to ensure that Obama is eligible. However, not for a second do I believe that they (overall) will not hesitate to neglect and break their oaths to the constitution.
Very few public officials take this oath seriously. Which is a shame since many of our veterans and soldiers do - in fact its one reason why they risk their lives. Sometimes even people who are not bound by oath, such as Berg and I, take its possible violations seriously. Judging by Mister C's comments and a few notes in my email box, it is a shame that we are treated with venom, derision and hate. (But there have also been a few notes of encouragement, thank you!)

With comments like that you sound more racist yourself. Whether Berg is right or wrong (most likely wrong) the media should have at least reported something about it the same way they did about Joe the plumber and other allegations
Media has reported in the past about vote fraud allegations, Clinton scandals, Bush DUI, a crazy woman in the McCain Campaing, untruthful things about Palin's family, McCain's suit about his eligibility because of the Panama Canal Zone; Bill Ayers; reverend Wright; even those 9/11 conspiracy crazy people have gotten coverage in the media disproving them.
That is what I find strange.
The media has not given Berg any coverage at all, yet they report on fake Joe the plumber.
