On June 12, the Supreme Court rewrote the Bush Administrations rules for the Guantanamo detainees. In a 5 - 4 majority opinion authored by Justice Anthony Kennedy, concluded that the prisoners held at Guantanamo Bay are protected by the U.S. Constitution on the grounds of habeas corpus.
Many Americans have been fearing lately that the Bush Administrations self-imposed right to detain anyone they want to and remove all their rights would someday be used to round-up innocent anti-Bush American citizens without warning and lock them up indefinitely without charges.
Such a treasonous plan has been in progress for some time and was documented in an article by Radar Magazine [link edited for length] about testimony by retired senior official to the U.S. Justice Department, James Comey.
The article also states that the Bush Administration has already began this plan, giving Haliburton a no-bid contract to begin building detention centers on bases around the country to detain uncharged American Citizens and other "Domestic Terrorists."
The ruling empowers the detainees to be given "prompt" hearings regarding any evidence used to justify their incarceration.
Many detainees will most likely be released.
The military and the Bush Administration will now have to defend any future practices in open court.
The ruling comes as the Bush Administration is under fire for its legal justifications of harsh interrogation practices, most of which are prohibited by U.S. and International laws.
Recently, retired Army Maj. Gen. Antonio Taguba, who investigated the abuse at the Abu Ghraib prison in Iraq, accused top officials in the Bush administration of war crimes for abusing detainees unlawfully held in various countries with torture.
This week Physicians for Human Rights released a report that found that U.S. military personnel (and other invited guests) have abused and tortured detainees. Those abuses include beatings, electrical shocks, sexual humiliation, water boarding and other inhumane practices. [link edited for length]
It has been reported that there is 27,000 people being secretly held worldwide. [link edited for length]
VIEW POINT:
The first steps in the Revolution are beginning to take shape and the American People are defiantly taking back their country.
It is so welcome to see that even with the questionable disregard in upholding the law when it comes to the Bush Administration by the FBI, the AG and other governmental law enforcement officials the United States Supreme Court still proudly stands up for the Constitution. (At least until George Bush fires them or has them locked away as enemy combatants).

Hooray for the SCOTUS, at least this time.

WE THE PEOPLE OF THE UNITED STATES, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty TO OURSELVES AND OUR POSTERITY, do ordain and establish this Constitution for the United States of America.
Think the Preamble just about says it as to whether the Constitution or the Bill of Rights and it's protections apply to either foreign prisoners or enemy combatants (or illegal immigrants for that matter). Appears it applies only to U.S. citizens, natural or naturalized, and THEIR POSTERITY (or children).
Too bad the average 6th grader can read and understand the Constitution better than our Supreme Court Justices can.
